WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISKS
READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS
In exchange for participation in pickleball and related activities (collectively, "Pickleball") at Venice Beach in connection with promotional activities by WarnerMedia Direct, LLC and its HBO Max streaming service (together with its affiliates, "WarnerMedia") on June 4, 2025 through June 8, 2025 (Pickleball and/or use of the property, facilities and services relating to Pickleball is referred to as the "Event"), I agree for myself and/or as the parent or legal guardian of, and on behalf of, the minor child participant(s) identified below (if applicable), to the following:
1. I understand that participation in the Event is a potentially dangerous activity that involves the risk of serious personal injury, property loss and death. I hereby acknowledge that I have voluntarily chosen to participate in the Event. I understand the risks associated with the Event, including, without limitation, latent or apparent defects or conditions in any equipment and facilities used in the Event, the provision, use or operation by WarnerMedia, Civic Entertainment Group, LLC ("Civic") or others of the equipment and facilities, my physical condition, acts of other people, acts or omissions of WarnerMedia and/or Civic or either of its agents or representatives (including negligence) and acts of God.
2. I voluntarily assume the risks arising from my participation in these activities and the Event. I certify that I have no medical or psychological conditions that would increase my risk of injury or death or would pose a threat to the health and safety of myself or others during participation in the Event. I further acknowledge that neither WarnerMedia nor Civic nor any of its employees, agents, and representatives have made any representations or promises to me, either expressed or implied, as to the Event.
3. I voluntarily release and discharge each of WarnerMedia and Civic and their respective affiliated companies, licensors, licensees, and their respective managers, directors, members, officers, employees, affiliates, agents, sponsors, contractors, subcontractors, successors, attorneys, partners, shareholders, representatives, and assigns (each, a "Released Party" and collectively, the "Released Parties"), from any and all liability, responsibility, actions, claims or causes of action, whether known or unknown, anticipated or unanticipated, for any injury, loss or damages of any kind, to myself or my property, relating to or arising from my participation in the Event. I FURTHER RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE ANY RELEASED PARTY IN CONNECTION WITH MY PARTICIPATION IN THE EVENT ON THE BASIS OF ANY CLAIM, INCLUDING, WITHOUT LIMITATION, CLAIMS FOR OR ARISING FROM: (I) ACTIVE OR PASSIVE CONDUCT; (II) NEGLIGENCE BY ANY RELEASED PARTY OR OTHERS IN THE FAILURE TO WARN OR IN THE OPERATION OF THE EVENT OR THE SELECTION, ASSEMBLY, USE, DESIGN AND/OR MAINTENANCE OF ANY EQUIPMENT, FACILITY OR SERVICES IN CONNECTION WITH THE EVENT; (III) NEGLIGENT RESCUE OPERATIONS OR EFFORTS BY ANY RELEASED PARTY OR OTHERS PRESENT AT THE EVENT; AND/OR (IV) MY APPEARANCE AT THE EVENT.
4. I also agree that I will not sue or assert any claims against the Released Parties for injuries, losses or damages sustained as a result of my participation in the Event, and I will indemnify and hold harmless the Released Parties from and against any and all claims, liens, agreements, contracts, actions, suits, costs, attorneys' fees, damages, judgments, orders and liabilities of whatever kind or nature in law, equity or otherwise, incurred in connection with any action that may be brought as a result of my participation in the Event.
5. I hereby waive any right I may have to a trial by jury in any action, proceeding or litigation involving any Released Party that is related to the Event or this document.
6. I understand the significance and consequence of, and agree that, all rights under Section 1542 of the Civil Code of California or any similar law are hereby expressly voluntarily waived in full by me to the maximum extent permitted by law. Section 1542 states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."
7. I hereby authorize and grant a perpetual, fully transferable, royalty-free and irrevocable license to WarnerMedia and Civic and their agents and designees (together with their affiliates) to (a) record by any means the name, voice, image and/or likeness of me (and/or the minor child participant) during the Event using any manner and media ("Recordings") and (b) use the Recordings, any biographical or personal information contained therein or otherwise submitted in connection with my participation in the Event, including, without limitation for advertising, promotional, commercial and marketing purposes, all without additional notification, permission or compensation to me (and/or the minor child participant), throughout the world, in all markets and media, now known or hereafter devised.
8. I have read this document carefully and understand that by signing it, I voluntarily surrender certain legal rights. Nonetheless, I agree that this document shall bind me, the minor child participant(s) (if applicable) and my/their respective assigns, heirs, executors, administrators and beneficiaries forever. I shall not be entitled for any reason to terminate or rescind this Agreement.
9. This waiver shall be construed in accordance with the laws of the State of New York. I agree that this Waiver and Release is intended to be as broad and inclusive as possible as permitted by the laws of the State of New York and that if any portion of this Waiver and Release is determined to be invalid, it is agreed that the remainder of the Waiver and Release shall continue in full force and effect.
10. The individual agreeing to this release represents and warrants that, as applicable, he/she is parent or legal guardian of the minor child participant(s) or he/she is signing on behalf of the individual participant and is duly authorized and empowered to legally bind the individual participant to this release.
